Food Truck Rental Agreement

This Agreement is entered into on [Date] ______________________________, by and between:

  • Owner/Lessor: Food Carts On Demand LLC, a [State] limited liability company,  (“Owner”),

  • Renter/Lessee: [Full Name/Business Name], located at [Address] ____________________________________________________________________ (“Renter”).

Owner and Renter may be referred to collectively as the “Parties.”

 


 

1. Rental Term

The rental period shall commence on [Start Date] _______________________________ and end on [End Date] ______________________________, unless terminated earlier in accordance with this Agreement.

 


 

2. Rental Fees & Payment

  • Rental Fee: $5,500 per 60 days.

  • The truck must be returned in acceptable condition and cleaned. The truck will be inspected upon return. The renter is subject to additional fees for damages, late return, cleaning, or unpaid fees.

  • All payments must be made in full prior to delivery of the truck.

  • Late payments may incur a fee of $300 per day.

 


 

3. Permits, Licenses & Legal Compliance

  • Renter shall obtain and maintain all required permits, licenses, and certifications (including health permits, business licenses, and parking permissions).

  • Renter shall comply with all federal, state, and local laws and health regulations.

  • Failure to comply is grounds for immediate termination, with no refund of fees or deposits.

  • Food Carts On Demand does not take responsibility over health department permits. This is the renter’s responsibility.

 


 

4. Use of the Food Truck

  • The truck may be used exclusively for food and beverage sales and related business purposes.

  • Renter shall not sublease, loan, or assign the truck without written consent from the owner. This will result in immediate termination of the contract with no refund.

  • No alcohol, illegal substances, or unauthorized products may be sold.

 


 

5. Maintenance, Damage & Repairs

  • The owner provides the truck in good working condition at the start of rental.

  • Renter is responsible for daily cleaning, safe operation, and proper care during the rental period.

  • Any damage caused by negligence, misuse, or failure to follow operating instructions shall be repaired at Renter’s expense.

  • If the truck is returned dirty, a cleaning fee of [$600] will be deducted from the deposit.

 


 

6. Insurance & Liability

  • Renter must carry commercial general liability insurance with limits of not less than $1,000,000 per occurrence and name Food Carts On Demand LLC as an additional insured.

  • If Renter will be driving the vehicle, Renter must also maintain automobile insurance with state-mandated minimums.

  • Renter assumes full liability for all injuries, damages, claims, losses, and expenses arising from use of the truck, including food-related incidents (e.g., foodborne illness).

  • Renter shall indemnify, defend, and hold harmless Food Carts On Demand LLC, its members, managers, and employees, from any and all claims, damages, or liabilities.

 


 

7. Indemnification

Renter agrees to indemnify and hold harmless Food Carts On Demand LLC against any loss, claim, or legal action resulting from:

  • Operation of the food truck,

  • Sale or consumption of products,

  • Accidents or injuries involving the truck,

  • Violations of law or health code.

 


 

8. Termination & Default

  • Owner may terminate this Agreement immediately if:

    • Renter fails to pay fees,

    • Renter breaches any terms of this Agreement,

    • Renter operates illegally or unsafely.

  • In such cases, the renter is subject to fees.


 


 

9. Governing Law & Disputes

This Agreement shall be governed by the laws of the State of New York.
Any disputes shall be resolved in the courts of [Your County/State], and Renter agrees to jurisdiction therein.

 


 

10. Entire Agreement

This Agreement constitutes the full understanding between the Parties and supersedes all prior discussions. Any modifications must be in writing and signed by both Parties.

Ticket & Violation Responsibility Addendum

This Addendum is made part of the Food Truck Rental Agreement between Food Carts On Demand LLC (“Owner”) and [Renter’s Name/Business Name] (“Renter”).

1. Responsibility for Tickets & Violations

The Renter acknowledges and agrees that during the rental period:

  • The Renter is fully responsible for all moving violations, traffic tickets, parking tickets, tolls, citations, and fines issued while the food truck is in their possession.

  • The Renter is fully responsible for all vendor-related tickets or citations, including but not limited to: operating without proper permits, violating health code regulations, or operating in unauthorized locations.

  • The Owner shall have no responsibility or liability for any such tickets, violations, fines, or penalties.

2. Payment of Fines

  • If any fine or violation notice is issued to Food Carts On Demand LLC as the registered owner of the vehicle, the Renter shall reimburse the Owner for the full amount within 14 days of written notice.

  • Failure to pay may result in additional fees.

3. Indemnification

The Renter agrees to indemnify, defend, and hold harmless Food Carts On Demand LLC, its members, managers, and employees from any claims, costs, damages, or liabilities arising from tickets, violations, or citations issued during the rental period.

GPS Tracking Disclosure & Consent Agreement

This Agreement is entered into on [Date], by and between:

  • Owner/Lessor: Food Carts On Demand LLC, a [State] limited liability company, located at [Address] (“Owner”), and

  • Renter/Lessee: [Renter’s Full Name/Business Name], located at [Address] (“Renter”).

 


 

1. Tracking Device

The Renter acknowledges and agrees that the food truck rented from Food Carts On Demand LLC is equipped with a GPS tracking device.

 


 

2. Purpose of Tracking

  • The tracking device is used solely for security and theft-prevention purposes.

  • Owner does not use the device to monitor Renter’s business operations, customer activity, or personal use beyond the scope of this Agreement.

 


 

3. Renter’s Consent

By signing this Agreement, the Renter:

  • Consents to the installation and use of the GPS tracking device,

  • Understands that the device may record location data while the vehicle is in use,

  • Waives any claim against Food Carts On Demand LLC regarding the use of such tracking data for security purposes.

 


 

4. Confidentiality of Data

Any data obtained from the GPS device shall be used only by the Owner for:

  • Recovery of the vehicle in the event of theft,

  • Verification of unauthorized removal or abandonment of the vehicle,

  • Compliance with law enforcement requests.

Owner will not sell, share, or disclose tracking data to third parties except as required by law or as necessary for security.

 


 

5. Breach of Agreement

Tampering with, disabling, or removing the tracking device constitutes a material breach of the rental agreement and may result in:

  • Immediate termination of the rental,

  • Additional fees.,

  • Legal action and recovery of damages.
